FAQ about games and esports lawyers

FAQ

01Can a banned account be recovered in court?

In some cases, yes. In Brazil the player-company relationship is usually analysed under the Consumer Protection Code, and the outcome depends on the evidence and the reason for the ban.

02Can a hacked account be recovered?

Yes. Through the courts you can request the return of the account and items and, in some cases, help identify who committed the fraud.

03What should an esports player contract include?

Conduct rules in and out of competition, streaming rules, a buyout clause if the player leaves for another team, a proportional penalty if either party terminates without cause, and penalties for breaking event or platform rules.

04What are my rights without a written contract?

Verbal agreements or deals made over messages can also be enforced, including in court, if you can prove what was agreed.

05Does the right of withdrawal apply to mobile games?

Yes, but each store sets its own rules. Google Play, for example, accepts refund requests within 48 hours. After that you need to contact the developer.

06Do you work across Brazil and abroad?

Yes. Work is done online across Brazil and includes international contracts and registrations for clients abroad.

07Is the outcome guaranteed?

No. No lawyer can promise an outcome. Each case depends on the facts, the evidence and what the other party does.

08Do you handle international deals for studios?

Yes. Agreements with foreign publishers and platforms and trademark and software registration abroad are part of the work with studios.

09How does it start?

With a short conversation to understand the case. Message on WhatsApp or book a slot on the online calendar.

10How do fees work?

Fees depend on the service and how complex the case is. They are set out in writing after the first conversation, following the Brazilian Bar fee table, with no surprises along the way.

11Do I need to visit an office?

No. Everything happens online: video calls, document sharing and digital signature of the engagement letter and power of attorney.

12Is what I send kept confidential?

Yes. Everything you share is covered by attorney-client privilege and handled under Brazil’s data protection law (LGPD).

13What should I send in my first message?

A short summary of what happened and whatever you have: screenshots, emails, contracts or support tickets. If something is missing, I will tell you what to look for.

14Can you help set up an association, team or league?

Yes. I handle bylaws, minutes, registration and tax ID, plus the rules and contracts so the team or league starts out properly set up.

15Are the books for non-lawyers too?

Yes. The trilogy is written in plain language for gamers, players, managers, creators and lawyers.

16Are the lessons for lawyers or for anyone?

Both. They help anyone who wants to understand their rights in gaming, and lawyers who want to work in the industry.
